Exporters and customs brokers assign an HS code to each product before shipment; for food items the correct code determines the applicable duty rate, any preferential tariff treatment under trade agreements, and whether the product is subject to additional import controls. The EU extends the six-digit HS code to eight digits in the Combined Nomenclature and to ten digits in the TARIC system, adding product-specific duty rates and policy measures. Misclassification, for example placing a processed berry product under a fresh fruit heading, can result in underpayment of duty, clearance delays or post-clearance recovery. Classification is based on the product’s composition, processing state and intended use, not its commercial name.
