Precautionary Allergen Labelling

Letter

Precautionary allergen labelling is a voluntary warning, such as a may-contain statement, placed on food packaging to inform consumers of a genuine risk of unintended allergen presence arising from cross-contact during production.

In trade practice

Under guidance aligned with Regulation (EU) No 1169/2011, precautionary allergen labelling must be grounded in a documented risk assessment of the production environment, not applied as a routine disclaimer. Tools such as the VITAL 3.0 protocol provide a structured framework for quantifying cross-contact risk and deciding whether a warning is warranted. Buyers sourcing from mixed-use facilities should request the underlying risk assessment rather than accepting a may-contain statement at face value. Blanket use of such statements without supporting evidence is considered misleading by enforcement authorities and can trigger rejection at border or retail level.

In a specification

A product specification or quality agreement should state whether precautionary allergen labelling applies, reference the risk assessment method used, and define the allergens in scope based on the facility allergen register.
